Does the defendant in this video have a case?  It's been making the run on FB and other sites.

I'd have to say "No Case" he clearly busted the law. The guy will have his day in court anyhoo to explain his side of the story. The cops were just doing their job rounding up a law breaker.

So detaining someone without Mirandizing them is legal.  Riight.  You're at a library, go look it up.

It would have never escalated to the point it got to until he refused to go along with the first officer who wanted to run his i.d.
We all know they have a right to check you out if you somehow get their attention diverted from what they were doing.
It's always best to watch, shut up and stand there without being seen or heard.
I am totally shocked they didnt march upstairs and talk with the video camera man.

We also know that if asked for your ID, you do not have to give it over if the LEO doesn't answer the question why he wants it.  Granted this guy was a little terse in his question asking, but he did ask.

So here is an event that happened in Phoenix today, an intoxicated 15 year old girl got into a fight with her mother in a parking lot. The event was captured by some one across the street and they caught most of the event. Police arrived and an officer tackled (some one called it a body check) because the 15 year old was refusing commands from the police. The media got ahold of this and claim it's "shocking" video of a police officer.

The raw video(wish there was audio as to what was said....

The officer is on paid administrative leave.

You could clearly see she was trying to evade the Police Officer, NOT !
The girl wasnt even running. The cop full on body checks her into the building. Hitting her head on the building before her head slams to the pavement. When he did it I was like Ohhhhh Damn !

News on six this morning reported on the two men posing as TPD and robbing three people at gun point. And this is what they told the General public to do if you feel uncomfortable when pulled over.
1. Call 911 and see if a Officer is indeed in your area.
2. Ask for(And get this)his commision card.
3. Make sure he is in full uniform.
4. Stay in your car and slightly lower your window just enough to pass out your i.d.
5. Keep your hands in plain sight at all times.

I always get a kick out of advice from people who have never been arrested or questioned by Police. Videos like this are just now getting around because of all the new technology. And believe you me, the Police dont care. The law will always side with the Officer. Choke a Ambulance driver cause you thought he gave you the finger. Take a paid vacation and then come back and assault a man in another mans driveway a few weeks later. No problem.
It was such a better World when we didnt have the video evidence of cops not acting like our T.V. heros Joe Friday, Steve McGarrett, Malloy and Reed.
Assault is assault no matter who does it on a 15 year old unarmed female.

P.S. just a tip. The first two on that list. I wouldnt try it. I'm not to keen on having a knee put to the back of my neck.

When asked for ID, just pull out a one dollar and a five dollar bill and say, "my name is Lincoln Washington" and hand them the money.

That should usually work.

It's the cops ball game, if you don't do as they say you'll find yourself eatting cement. Do what they say and latter, if the cops broke the law you can address that issue. Being "Mr. Tuff Guy" won't work, it will just get ya few years behind iron bars. The Phoenix video is an example.

The defendant has a case, yes, because police moved on him as a direct result of the defendant exercising his right of free speech.  That's not to say all free speech is a good idea, but it's still legal in the USA.
The degree of escalation seems to multiply proportionate to the bruising of the egos, as well.

Taking the higher ground doesnt necessarily mean using the most force, it could just as easily have been a matter of acting like a professional and going about your business.  Both parties could have taken that route, but only one is held to a standard that expects them to.

Harassment arrests arent expected to stand up in court, that's not really the point of doing them.

Given the increase in the numbers of arrests where the only charge is "interfering" or "obstruction", and people having cellphone cameras confiscated, I would say there was some coordinated concern.

NYPD == LAPD.  Same thing...

I guess you can't expect anything different when you get millions of people together in a small area.
