Question for the Lawyer types

Okay, so my dog (German Shepard mix) is in my mother's care.  She is often alone, so I leave him there for safety purposes.  There is a woman that has been walking her dog down the sidewalk out front for a while.  My mom's chihuahua hates this dog, and has gotten the others to agree.  Every time she comes by, which is every single freakin day, and the front door is open, the dogs go nuts trying to get through the glass door.  Last Fall, while Mrs. Nox was there taking care of the dogs while she was gone, the door didn't get latched good and he knocked it open and went after this dog.  Mrs. Nox was right behind him, grabbing his tail and pulling him back, so no serious damage was done.  The lady took off with her dog, never heard from her on the whole ordeal. Took next to no time before she was back to walking the dog down the street again (btw, she could easily take another route, it's not like it's the only way she can go to get to where she walks to).  Now, almost a year later, he managed to push through again, with my mom and aunt right after him (pretty sure my aunt didn't get the door shut well).  All three of them ended up getting peppersprayed.  Now my question is, which is what my mom is worried about, how open is she for any kind of suite on today's escape?  She thinks the other dog had some blood, but not sure.  The woman was not harmed in any way.
