And Hoss, I'm with you.  Bring back the Line-Item veto.  It puts the responsibility on the executive branch to actually read legislation and face sole responsibility for it's content.

Sorry, but the definition of earmark requires funding:

"In US politics, an earmark is a congressional provision that directs approved funds to be spent on specific projects or that directs specific exemptions from taxes or mandated fees." - from Wikipedia

OMB defines "earmarks" as "funds provided by the Congress for projects, programs, or grants where the purported congressional direction (whether in statutory text, report language, or other communication) circumvents otherwise applicable merit-based or competitive allocation processes, or specifies the location or recipient, or otherwise curtails the ability of the executive branch to manage its statutory and constitutional responsibilities pertaining to the funds allocation process." - OMB's website.
