Okay on February 19 I went and filed for the Emergency Protective Order. They granted it to protect me but not my children. They said I have to prove she's a threat to children. Also I have to prove she has tried to harm a child or would harm a child. Which shouldn't be too hard. I found out recently from my husband's dad that she tried to kill my husband when he was 2 weeks old and also at 4 months. When he was 2 weeks my Father In Law came home from work and she had my husband in nothing but a diaper on the floor with candles all around him. My FIL was like "WHAT THE HELL ARE YOU DOING?" She replied "I'm Virgin Mary and this is Baby Jesus and I have to sacrifice him. So my FIL instantly took my husband to his parents house and took her to the mental hospital. So I'm taking him to court but I have a feeling her Attorney is going to say it's irrelevant to the case since it was so long ago. Which I don't see how it could be because it's proof she has tried to harm a child. Also when he was 4 months old she stopped on a bridge in the middle of winter and he was crying and got out of the car. Luckily his dad's Sister(Aunt) was with them and she got out and said "What the hell are you doing?" She replied "I can't take it anymore I'm throwing him over the bridge!" His aunt was like I don't f*cking think so! His mom replied "Okay" and got back in the car and drove on. Also I found out from her ex husband that when she used to watch our 2 year old that she allowed her to play with chemical cleaner bottles and get into the bathroom cabinet and play with razor blades. Also at one point we took our daughter to her Pediatrician to make sure she hadn't been molested because everytime she would come back from my MIL'S house she had diaper rash cream inside her you know what. Which luckily her pediatrician said nothing had been inserted into her. But just by looking couldn't tell if she had been touched inappropriately. Which he advised us to not let my MIL around her anymore. But does anyone have any advice on anything else I could do to prove she's a harm to a child??? Or are there any attorneys on here that can tell me who I need to have subpeona her mental health records to court???? I did send off to get a copy of my phone records to prove she has been harassing us. I should have them before the court date next week. I appreciate any advice. Thanks for helping.

You need to make sure you have as much first hand accounts as you can.  Stories that have been passed on to you will not be admisable, and will fall under heresay.  So to prove a threat to your children, you would need to show that she is a threat to them, not that someone had told you that she was once a threat to your husband.  I would really advise hiring an attorney.  If you can not afford one, talk to family and children services, they can point you in the right direction for getting some legal aid.

Sorry, most people don't have experience with this situation, so you aren't going to get much response from here.

A blood relative to your mother in law can submit a 'petition for mental health hearing' at the courthouse, 2nd floor, probate office.  They will take her somewhere for review for 72 hours.  Then she can get the psychiatric help it sounds like she needs.

Do you think that a protective order is going to register with her if she is that far gone?
