Well, in keeping with my extremist positions, I reiterate; texting and cell phone usage that involves an accident should be a felony.  Identical to drunk driving.

I don't share my thoughts because I think it will change the minds of people who think differently.  I share my thoughts to show the people who already think like me that they are not alone.

In principle, I agree. In practice, it's somewhere between difficult and impossible to tell whether someone sent a text message while stopped or was sending it while driving down the road at speed.

What about eating a McRib, or drinking a Big Gulp, or applying makeup?

Back in the day, I can't tell you how many times we pulled up to a scene that looked really bad, only to find out that the guy who plowed into the back of the person at the stoplight was simply covered in ketchup from the Big Boy that he was eating.

Should having an accident while distracted by a cell phone carry a higher penalty than having an accident while distracted by any of the other 10,000 stupid things that driver's do?

And the law ain't workin'.

How about 'hit and run'.  There are dozens a day of those.  Against the law?  Yeah.  Any consequences?  Naw...why bother...insurance will take care of it....

Considering my insurance seems to go up 5 percent every 6 months, and I haven't had a claim nor a ticket in over 20 years, then it damn well better take care of it.
