I've had it with our legal system!!!!

My kids are miserable with their mother, and are emotionally abused there.  The person that was physically abusing them is temporarily out of the picture, so nothing will be done about that.  Now, trying to deal with the courts, I'm getting screwed over because I can't afford the exorbitant fees that attorneys charge.  The whole system is set up to generate money for this profession, to hell with anything like justice or making sure kids are taken care of.  We argue on these forums about what's wrong with this city, state, and country, but never discuss how our legal system is engineered to screw over people instead of help them.  Hell, this is almost enough to drive ME to criminal activity.

I felt that way when my business started to fail and I had to file bankruptcy. It seemed like the entire legal, government and banking systems were loaded for bear and aiming at me. Fortunately, I found as I persevered that there are indeed decent, honorable, justice seeking people in all those industries. They want to get paid but they still have integrity. There are also lots of people who have traveled your same path and will commiserate with you then give you the motivation that you can wade through the muck and come out okay. I remember you as a pretty bright guy with strong passions. My guess is you will find them or they will find you pretty soon. Good luck.

The problem is, while fighting through all of this, it's the kids that are getting crapped on.  And it makes it even harder to do anything in court when my exs attorney is willing to lie about things.  One of the concerns is that the kids are failing classes (the younger of the three is failing everything except band and art), my ex doesn't even care enough to do anything about it, except try to drug the hell out of them, and the courts won't even do anything this semester, period.

Yep it all revolves around money and lawyer costs  to court fees. A trial is really a game not about who's guilty or innocent, but upon which lawyer can put on the best show. It is what it is.. :-\

Have you tried working with legal aid or other services that help people with lower income? If they can't help you directly they might be able to refer you to someone.

Cus. I have been there and done that. I fought with DHS and the Court system for over four years and racked up Attorney fees that I am still paying off to this day(almost done)
You're Ex sounds a lot like mine did. She WILL MESS UP. Trust me. Her hatred of or for you will come back to bite her in the a$$. Oklahoma is a backward State when it comes to awarding custody to the Father. But it is getting better. I have had full custody of my two boys for seven years now. It can be done. They just make us men work a little harder than they do the victim women. Hang in there Bud. I am living proof that there is a light at the end of the tunnel and kids are smart. They know which parent is doing the right thing and it will make all the differance you will need.

Legal aid will only help if there is domestic abuse.  Already tried them.  Even the courts no longer have the funds to provide an attorney for the children.

You have to understand that family court is where they all get smile on. As far as most of the public is concerned, they can do no right, even when they are in fact doing the right thing. Abusive daddy thinks that the system is stacked in favor of mama and abusive mama thinks that the system is stacked in favor of daddy.

It is actually true that in many states the mother gets custody be default, but there isn't anyone that wants to see kids left in an abusive household. Problem is that most of the claims of abuse in family court are complete BS, so they end up being overly skeptical when actual abuse does come around.

Basically, you need evidence. That means doctors. In your case, since the abuse is emotional, you need some sort of therapist to write a report saying your kids are being emotionally abused by their mother and that she should not get any unsupervised custody of them. (I'm no lawyer, but I've known several folks who have been through this sort of thing)

Maybe guido knows someone who would be willing to help for a reduced fee?

This goes beyond the abuse (which is just emotional at this point, and even harder to prove), it's that the kids are miserable, doing horrible in school, and just need in a better situation, and instead of making things better for the kids, the court is just dragging things out and making it so that I can't do anything without an attorney.

The constitution says a person is entitled to be represented by an attorney but when you go into that court you better have an attorney.  Your case has been decided in the judge's chambers and you may or may not be permitted in his chambers.  It is judge's decision.

Some nations, who have had courts for thousands of years, use three judge panels.  Only one judge of the three can have any legal training.

Incarcerated prisoners have been able to produce many outstanding legal briefs that were allowed by the court.  The law requires a full law library of current law books.

Want to be you own attorney?  Don't like the system?  The game plan is "they are all attorneys" and you are the football that is going to get kick around. 

Don't forget to vote to change the system by rewriting the constitution so we can start to gather some three trillion sheets of paper to re write it on.
