South Yale Construction Penalty

The Tulsa City Council is getting ready to debate whether Sherwood Construction should be held to their original contract that calls for $$$ penalties if the project, widening of Yale between 71st and 81st, goes past the due date.  The due date was last November.  The penalty is at $900,000.

I say don't waive the penalty.  Oklahoma is setting records every day for the number of days we've gone without rain, which leads to more construction days.  You can't tell me the company would ask to waive their reward had they completed the project ahead of time.

If the City Council chooses to waive the penalty, why should any company strive to complete a project on time if they know the Council will simply waive the penalty.  The rewards/penalties for contracts should not only go in the contractors favor.
