Refusing any test gets you an automatic six month suspension of your driver's license, far more then if you take the test.

And, the police determine what test you take, not the person arrested.  You may request a blood test, but only after you have accepted a breath test, and then the blood test is at your own expense.  And no matter what, the tests have to be given within two hours of the arrest, so planning to beat a test because of some huge time frame won't work.



Yes, but in an hour you might drop from DUI to DWI, and the suspension would still be a possibility without the refusal of the test.

Actually, like all criminal cases, this isnt a private matter.  It is a matter of public record:

I dont particularly care; its not like I think she is a worse person for driving drunk than anyone else nor do I think it is a reflection on the mayor.  I am just glad she appears to be getting the same treatment as everyone else.

Just curious how you found it on OSCN, I searched it and came up with no records.  I was told over the weekend this wasn't her first stop for a DUI, but you know how rumors are.

Don't ask me how I know this, but from what I gather, if it's your first DUI offense, have an otherwise clean record and aren't an donkey to the arresting officer(s) ...

Many municipalities will defer prosecution for a certain amount of time and require the offender to attend DUI school and take an alcohol abuse assessment. If those are completed satisfactorily by the court's deadline, defendants can often plea-bargain the offense down to reckless or careless driving, pay a fine, do community service or a combination of both.

At the same time your driver's license (the actual plastic card) is taken from you while you drive with a temporary one -- first your copy of the citation, then a letter from the Department of Public Safety, then a "modified" license.

To get that license, you must, like someone said previously, have an interlock device installed on your car. You blow into it to start your car and at least once while it's running. You have to do that for six months.
