Do you mean you want a law that talking on the phone while getting into a car accident raises a presumption of negligent driving?  As far as I'm concerned, distractions are distractions.  If I'm on my phone or not and you pull out in front of me... your fault.  If I pull out in front of you... my fault.

The action resulting from the distraction is proof enough in most instances.



I followed a driver on the Creek Turnpike today that twice drifted onto the shoulder.  I finally went around and noticed the driver talking on a cell phone. A mile or so later, the same car passed me while I was still at the speed limit of 65.

Not everyone has your superior mental capability.

The word "Banning" should scare every American.  Government is in our face enough, how about we just pay attention to the task at hand when we are in the car???  Write heavy fines when it causes an accident and maybe people will think twice about it.  I also ride a motorcycle and that scares the hell out me that someone was actually talking on the phone on a bike.  [:O]
