I think the statute speaks for itself.  If you wear apparel that appears to drape yourself in the American flag, I (personal opinion here) consider that low-class and disrespectful of the colors.  Wearing patches, especially if you are a LEO or in the military, isn't the same as what this statute implies, because you are representing your country officially and on duty.
