Great IDEA for his community service!  I hope his judge and KTUL are taking NOTES.

Hey, if KTUL allows Bill Mitchell to spill his guts about the heavy smoking, why not let Jerry keep his job and spill his guts about the heavy drinking.  Could be great for sweeps season, ESPECIALLY if DPS nabs DL and the judge orders bike duty.  I'd CERTAINLY watch Inside TULSA Edition.  [:P]

Refusal will bring an assumption of guilt for license revocation (same as failing the test, it is revoked) as well as a DUI charge (BAC > .08).  You have implied consent by driving on public roads in Oklahoma.  So by refusing, you are revoking that consent and must face the consequences.   If you are stopped and requested to take the test and informed that refusing will result in lose of license, the State has the beeline to taking away your license.  

While on the subject, never take a field sobriety test.  When given in laboratory conditions (for evaluation purposes) the officer's guessed correctly 65% of the time.  So 45% of the time they were wrong WITHOUT a suspicion of intoxication (or they wouldn't request the test).  There is no Oklahoma penalty (that I am aware of) for refusal.

Generally, I have been told to take the test and worry about defeating it later.  Refusing to take the tests allows a presumption of guilt as well as telling the jury you refused so you must be guilty (can't do that with any other crime, where you have the right to remain silent).  Perhaps opinions differ - I'm not expert in the area.

DUI is a bit of a witch hunt.  Clearly driving drunk is a bad idea and dangerous, but you are guilty until proven innocent, the court costs are higher than nearly anything else, and the punishment doesn't usually fit the crime.  The firm I linked above (which has the most clear website I found in a brief search) has an interesting list of things that are different in DUI cases - guilty until innocent and what-not:

Per this guy - just like any other.  It appears he made a stupid decision to drive while drunk.  We don't kick out legislators for drunk driving, we elect them to the white house, they coach all over the nation... why not give the news?  His ability to deliver some fluff piece on how hot it is probably won't be effected by whatever he does on a Friday night.

One more complaint, a guy loses their CDL for a DUI.  That seems harsh for a truck driver, cop, post officer worker, delivery guy etc.  Taking away their livelihood for a dumb decision on personal time.  Second offense - sure.  Bah.

/I don't drink and drive or even come close, no convictions of DUI ever, so my view is not based on personal bias.  And again, I only know what I've been told about DUI law.

There but for the grace of God go um, most of us? Driving under the influence is reckless, dangerous and shows an utter lack of respect for life - and I'd hazard a guess to say most of us have probably done it at one time or another in our lives. Most likely, the difference between Jerry and us isn't that we've never made a reckless choice... rather, the difference is that we weren't caught. And perhaps, too, we realized the terrible consequences our actions could produce at a younger age than Jerry.

His license will be suspended for 6 months whether or not he's actually convicted of DUI. It gets suspended any time you blow over the limit or refuse the test, no matter what goes on your record.

He may be able to show he needs to drive to earn a living, in which case he might qualify for one of those alcohol interlock devices while his license is suspended. Or, since TV reporters always have a photojournalist in tow, perhaps his camera operator will have to drive him around everywhere.

If this is his first offense, it wouldn't surprise me if he gets off with a plea deal down to reckless driving if he satisfactorily completes everything the judge orders. It's a fairly common practice for first-timers, I'm pretty sure. But it sure won't be cheap.

That's consistent with what friendly cops tell me, as well as what I've read about off-duty cops pulled over outside their jurisdiction.

From this post and MH2010's observation on how little it actually takes to fail a breathaliar, im getting the impression DUI is more a cash cow than a public safety crisis.
While I believe that dangerous drivers shouldnt be on the road, it seems some purity was lost in the zeal to go after anything alcohol-related.

And though I havent been through the paces myself, it does seem that the whole DUI scene goes against the rules of our legal system -- perhaps for revenue, or just to placate the exaggerated morals of the powerful.

The Mayors daughter seems to have survived the ordeal without the total collapse of order, maybe we just make too much of this altogether.

I take drinking and driving very seriously.  Two friends of mine were killed in high school and another is a parapalegic.  

However, if he was .08 that is a tough call, I think the legal limit is .08 is it not?  Which means the guy had a beer or two at dinner?  

Also are there any links with the story as opposed to speculation?

hell, to get .08 on okie beer he would have had to drink a lot of them, which means he was probably inebriated by water more than anything else.[}:)]
