Hit pothole causing $500 in damage, guess I'm SOL?

Tooling around in BA, around Forest Ridge (81st and 241st).  Yeah, the roads are bad I know but I was taking my time.  I thought I was doing great and then I took a turn and BOOM... yeah, ran into a pothole I didn't see.

From what I've gathered so far, I can report a claim to the City all I want, but they'll just deny it.. dam f'ers.

So I guess I'm just SOL?

No wonder you screwed up the rims.  I have 55s on my Avenger and worry about potholes.  I have a special sense for em now and haven't had any problems (knockwood).

But no, you probably have no recourse.  Doesn't mean you shouldn't call and ask.  Is that even city land that far out?  Has BA even annexed that?

I'm guessing it's the tire that costs the 500 with that size.  It appears to be from a Vette or maybe custom for a truck?  Are those Bridgestone Potenza's?  TireRack.com has em for 432 bucks.

It's an '07 Z06 Vette, tire is the OEM: Goodyear Eagle F1 Supercar EMTs.

It's just cosmetic damage, the curb protector was ripped away.  The wheel is fine structurally.

1 tire from TR is $400, then figure $20+ to get it mounted.  Wheel is chrome from the factory, so whatever Fixrim will charge for that.

I'm probably closer to $600 now that I think about it

Can you claim it on your insurance? What is your deductible? Might go that route then submit the claim to BA for reimbursement. Check with your agent if you haven't already, he may know the way for you to gewt BA to pay for the repair and or replacement. The city I work for pays out about $500k a year to civilians for damages to cars from accidents with town vehicles to claims from road problems and debris. Check withg the Loss/Prevention Department at BA City Hall.

He must see the wheel with the tire removed to give an accurate assesment and if repairable then a price quote for repair.

Many alloy wheels today are unavailable for replacement, making the repair necessary if one chooses to keep the style of wheel they own. Alternative is to purchase an entire new replacement set that is not the same.

You're screwed.  

In general you can not sue the government.  The government has allowed some suits against them if they were negligent.  Potholes are considered normal wear and tear in a street.  Barring something spectacular (3' sink hole unfixed for a week) they will not be held liable.

Furthermore, it is very possible that the damage occurred to your vehicle because of the equipment you chose.  Generally that is a non-issue, but you specifically made your vehicle less road worthy and more susceptible to damage knowing that the choice would do so.  Thus, the city could argue, even if they were liable, that anyone could make their vehicle susceptible to damage and a precedent would bankrupt municipalities should others make aesthetic choices that lend themselves to damage.

In general, by driving on public roads to accept the risk of defects in that road barring some sort of negligence.  Failure to fill a pothole is general not negligence.  Therefor, you are likely screwed.

Stock wheels and tires is an equipment choice that makes the car more susceptible to damage??? A 30 profile tire as a percentage of a 325 wide is not THAT low profile. 30% of 325mm = 97.5mm.. my stock tire size is 235/40 which gives me 94mm of sidewall.. his tires have more meat than mine do.

The stock wheels and tires on my tiny geo-metro like car I had before this one were 185/65 which would give it 120mm of sidewall... oh boy another 2 centimeters! This has nothing to do with "choice of equipment."

If the damage occurred on tires THIS low profile, which are not stock.. maybe you can blame choice of equipment:

Depending on  how often you damaged your vehicle, it might make up for the terrible gas mileage.

I know very little about custom wheels and I paid little attention to the exacting facts in this case.  I saw that he listed a full sentence of details on his wheels, so I assumed they were custom.  Thus, I outlined an argument that might be made by the City if he made a claim - if they were liable.  Which they aren't.

I destroyed a rim on my Altima with stock wheels that were smaller than those he mentioned on wonderful Tulsa roads.  I was just making an argument to fill in the answer a bit.  The short version is:

The city is not liable for bad roads, you're screwed.

I also destroyed the rims on a motorcycle yesterday on Tulsa roads.  Though, as it was sliding sideways I don't think it was really  the roads fault.  [xx(]
